Changes in legislation of the Russian Federation in the field of accreditation of branches and representative offices of foreign legal entities and its employees as well

There were made some amendments to the current legislation of the Russian Federation in the field of accreditation of foreign branches and representative offices in the territory of Russia.

The state body in charge with accreditation nowadays is Federal State-Funded Institution "The State Registration Chamber at the Ministry of Justice of the Russian Federation". 

According to these amendments, functions on accreditation of branches and representative offices of foreign legal entity are transferred to authorized federal executive body which has to be defined by the Government of the Russian Federation. It is planned that it will be the Federal Tax Service of Russia.

The exception is made for branches and representative offices of foreign legal entities in the field of civil aviation and representative offices of the foreign banks. Their accreditation in under control of Federal Air Transport Agency and the Central Bank of the Russian Federation respectively.

The Chamber of Commerce and Industry of the Russian Federation is discrediting the grant of permission to open foreign companies and the organizations in Russia, members of Chambers of Commerce and Industry are interested in cooperation with.

At the same time to the Chamber of Commerce and Industry of the Russian Federation are assigned the functions on personal accreditation of foreign citizens - employees of branches and representative offices of foreign commercial legal entities.

The federal law comes into force on January 1st, 2015, except certain provisions for which other compliance date is provided.

According to the legislative changes specified above, considering all processes and customs of accreditation of representative offices and branches of foreign legal entities’ practice, and also taking into account organizational difficulties and transition period specifics of delegation of state bodies authority we recommend to make all necessary procedures for your representative office or branch (primary accreditation, closing of representative offices and branches, introduction of changes, accreditation of employees) in advance, before the effective date of the law.

Till April 1st, 2015 all branches and representative offices should file documents for registration in the State Federal Tax Service register if their accreditation terms are not expired till the specified date. If this requirement is not followed the accreditation will be terminated.

Branches and representative offices which accreditation expires in January, 2015 may apply to the Federal Tax Service for prolongation of their accreditation till February 28th, 2015. In other cases, all documents for prolongation of the accreditation should be filed within 30 calendar days before the accreditation expiry date.
